Amended Ordinance #11, 2012

An ordinance to adopt a trash fee that will be added to Peru Utilities monthly bills.

Whereas, State imposed property tax restructuring of local government has caused declining revenue to operate city services; and

Whereas, the removal of garbage is for more than the mere convenience of individual residents, but rather to protect the public health of the entire City of Peru by minimizing or eliminating a source of unsightly disease and odor within the City; and

Whereas, the City of Peru finds it beneficial to its residents to provide such services; and

Whereas, the City of Peru deems it necessary to collect sufficient revenue by establishing a “user fee” (allowed under IC 36-9-30-21) to be able to continue these services; and

Whereas, the City of Peru owns Peru Utilities and has the ability to add a “user fee” on the monthly utility bill to help offset the lost revenue; and

Whereas, the City of Peru Common Council authorizes the Mayor to enter into an Inter-Local Agreement with Peru Utilities to establish the process by which the funds will be collected.

Now, Therefore, be it Ordained by the Common Council of the City of Peru, Indiana That:

Section 1:

A user fee of $20 per month is hereby established for trash collection beginning December 1, 2012, for all city residents and any business that may qualify for trash collection per the City Ordinance.

Section 2:

Unpaid fees may be assessed by the City against real property as provided in Indiana Code 36-9-23-31 through IC 36-9-23-34. If fees assessed against real property are not paid within twenty (20) days, a penalty of ten percent (10%) of the amount of the garbage fees attaches to the delinquent fees consistent with the Peru Utilities billing and collections processes for all utilities. The fee amount, the penalty, and reasonable attorney’s fees may be recovered in a civil action in the name of the municipality.
